The Individual with Disabilities Education Act of 1997 (P.L. 105-17) is a federal law which mandates a free and appropriate public education for students with disabilities. Maine State Education Regulations define a student with a disability as having one or more of the following disabilities: mental retardation, hard of hearing, deaf, speech, and language impairment, visual impairment, behavioral impairment, orthopedic impairment, other health impairment, learning disability, deaf/blind, multihandicapped, autism and traumatic brain injury. Children with disabilities are identified through a referral system and a Pupil Evaluation Team (PET) process. Referrals may be made by parents or teachers who have reason to believe that the student may have a disability which requires special education services. Students may also refer themselves. Parents are notified when a referral has been made and parental consent is required before any special education evaluation or service is provided. The Old Orchard Beach Schools provide a continuum of special education placements in order to meet the needs of students with disabilities. Special education services (such as resource, consultation, and monitoring services) are available in conjunction with regular class placements, self-contained placements, and tutorial services, including hospital and homebound services.
